These Terms of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Evgeniy Butyrin (FOP), concerning your access to and use of the DrumFillGenerator mobile application and website (collectively, the "Services").
By accessing the Services, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are explicitly prohibited from using the Services.
1. Description of Services
DrumFillGenerator provides an automated smart linear drum fill generation simulator for drummers.
- Free Tier: Grants limited access to basic single-bar generation layouts, standard time signatures, and fundamental subdivisions.
- Premium Subscription: Unlocks advanced multi-bar generation capabilities (up to 4 bars), expanded subdivision settings (triplets, 16th notes), additional custom electronic sound banks (e.g., 808 Kit), and interactive finger-scrubbing controls.
2. Billing, Subscriptions, and Trials
- Auto-Renewable Subscriptions: Payment for Premium access will be charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing cycle.
- Free Trials: If offered, a free trial period converts automatically into a paid monthly or yearly subscription unless canceled manually within the specified trial window.
- Localization & Tiered Pricing: Subscription fees are dynamically adjusted based on geographical markets (USD for USA, EUR for EU, localized Tiered Pricing for Ukraine). All currency transactions are securely processed by Apple.
- Refunds: All financial transactions, billing disputes, and refund requests are handled exclusively by Apple Media Services Support. We do not possess the authority to process direct user refunds.
3. Intellectual Property Rights
Unless otherwise indicated, the App, its source code, algorithm logic, visual Dual-UI frameworks (Grid/Notation layouts), SF Symbol integrations, database schemas, and preloaded proprietary audio buffers are our exclusive property and protected by copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to download and play with the App for personal, non-commercial practice use.
4. Prohibited Activities
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the underlying mathematical logic of the Randomizer Engine or audio pipeline.
- Exploit the App's one-shot audio assets outside the context of personal drum practicing.
- Use any automated scripts or bots to crawl data from the App interface.
5. Limitation of Liability
The App is provided on an "as-is" and "as-available" basis. While our core audio engine is highly optimized via native hardware clock synchronization, we are not liable for subtle tempo drifting, audio latencies caused by faulty third-party Bluetooth hardware, or any hearing damage resulting from improper headphones volume utilization during drum training.
6. Governing Law
These Terms and your use of the App are governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law principles. Any legal actions arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ukraine.
7. Changes to Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. We will alert you about any changes by updating the "Effective Date" of these Terms.
